filing for unemployment question
okay i wished i posted this yesterday because i just had the interview with the deputy from unemployment
i was notified in april in written that i was missing to much time
reason i have a 2 year old who went to a babysitters and was always bring home some type of flu
i was having a lot of stomach issues but didnt have the insurance to go to the doctors each time so sometimes i had a note and sometimes i didnt the doctor thought with out testing me (because no insurance) i needed my galbladder out..turns out after my dismissal i am pregnant and have been for a little while
the employer response was that it was a misconduct
so is that truly misconduct for missing time, with one warning? we did have to sign a letter stating we were basically disposal when ever they saw fit, i was there almost a year, i had 18 occurences thats what got me dismissed. now occurences were explained that if you were sick monday you got an occurence and the rest of the week followed that one occurence when actually if i called monday and tuesday for me thats one and say my toddler got sick tuesday night and wedsnday thats another occurence even through i was out consecutively
am i making since so far??
so basically im scared that i wont get the unemployment becuase i didnt follow policy on the missing time, but the employer missed the deputy call too we are supposed to be on the phone at the same time and we are sent notification ahead of time. but now i cant get employment im pregnant should i have made that known??

Hello:
I am in the same situtation. Lost my job April 30. I know unemployment can be scary.
1. The interview is standard. When ever someone is let go they do the interviews
2. You were not let go for what unemploymnet considers misconduct. Misconduct in their eyes is stealing, violence etc.
3. They will consider it performance. If your employer does not answer the unemployment inquiry then you automatically get your unemployment.
DO NOT say you can't work cause you are PG. That alone will deny your unemployment. You can still look for work. You can't help it if people don't hire you because you are PG - which is against the law. But if you tell them you can not work M-F during regular business hours then you will be denied.

I have been on the other end- the employer's. We had to let a woman go because she created a hostile work environment. We had 15 reports and 72 pages of documentation on incidents and counseling we did with her. They still awarded it to her. So, my perspective is listen to the advice Savin4Disney gave but try to relax. I am pretty sure they will side with you. Sorry you are having issues, but this could turn out to be a blessing for you.

I think the first time anyone goes through this they are freaked out. I was too but now the second time around I am okay. I already knew where to cut back.

Just wondered how you made out. I know that the rules vary from state to state, but here in MA if you weren't fired for stealing, vandalism, or something like that, and as long as your are available for work and looking for work you qualify. I didn't have to do an interview for my stint on unemployment because I was laid off, but I know many employers who won't challenge the state's decision because it's not worth their time.

I hope it worked out for you, I know that I was let go with no reason and was told I didn't need a reason. I filed for unemployment the very next day and it was never challenged. In NY State at least most employers make you sign a form that says you understand that you are an "at will" employee, which means that at any time for any reason or none, you can be let go from the job or you can leave the job. I had never been given any kind of warning or told that my job would end, I just came in one day and was told that I didn't work there anymore. I have since found a part time job and really enjoy my co workers. I hope it all works out for you
