I want to kick my mortgage company in the kneecaps!
I don't want to post the name of the mortgage co (well, I do but I don't think I should)- they are KILLIN me. They are very well known and are going under. So, back in Dec they told us we had a missing payment (despite the fact that they went over every single payment with me, the date received, check number, and amount). They could not explain where this "missing" payment was from.
So, in January they finally admitted they were in error. A letter is being sent to me stating that my account is current, etc. THEN, I just checked my online banking for an account we don't use anymore. EGAD! A flipping withdrawal was made on Friday by the mortgage company. They have no record of the withdrawal. I didn't make a payment. I am waiting for the bank to open to find out what is going on- but for now, there is a thousand dollars missing from my account AND we are overdrawn so we have an overdraft fee!
THEN, to make matters worse, I called the mortgage company today to see what was going on and they said that SEVEN payments were made in January. (apparently they backed out all my payments and resubmitted them in January). It is so messed up- I am afraid to even call them because every time they access my account there is some sort of disaster.
I googled the mortgage company and they have a bazillion complaints out there. I can't wait till they fold and our mortgage gets sold.
Just snarky this morning.. it is MADDENING. *sigh* Is there a "frying pan over the head" emoticon here? HA!

That stinks! We had that problem in 2007 with our mortgage company. At the beginning of 2008, they were claiming that we were behind on one of our payments. When I went back over our checking account, I had made 12 payments, so I couldn't figure it out. Every payment was accounted for.
Well, come to find out, we made our January 2007 payment early in December of 2006, so they were only showing 11 payments in 2007. It was ridiculous. They wanted us to make another payment, even though we were current. I had even used their payment slip to show that it was a 2007 payment, but someone along the line had applied it to the mortgage incorrectly.
I made a huge stink about it, and they made it right, but it still ticked me off. So, I feel your pain in dealing with them. Every time I have to call and actually talk to someone at our mortgage company I cringe. They are all bunch of lunkheads!
I hope you get everything figured out!

UGH!!!! I just went into my online banking and it is showing that the payment was re-credited to my bank account, which I think means it was "returned" to the mortgage company even though it was never actually taken out, so they are probably now going to say "a payment was returned to us so you are now a month behind". should I be this stressed at 8:00am? I need to do some yoga or something.

Go ahead! DO IT!! Beat the ever loving crap out of em!!! This sort of crap is going to start happening alot. You just watch. Thats why I really think there should be an overhaul on all the different kinds of banking ententes. It's just ridiculous out there!
I hope you get it straightened out.

I don't have any advice. I wish I did. Is there someone you can report them to? I hope they get this situation with you under control. I'd feel the same way you do. Sending you hugs and you're in my thoughts.

I'm thinking you might want to touch base with a lawyer, see if there's anything you can do about this behavior on their part.
If you could kick in the pants the person responsible for your problems, you wouldn't be able to sit for a month.
Did you know that a 4 year student paying $20,000/year who finances their education graduates with over $103,000 in debt to start? But a student who works and pays cash and takes 6 years to graduate ends with $6,300 in their pocket! So much for "getting a head start by financing!"

You want to document a paper trail with this company.
And whenever you talk to someone on the phone, get their name, date, etc, down on paper.
I would be pulling my hair out in your situation.
When we got our mortgage paid off 4 yrs ago, I of course wanted our paperwork from the bank. They told me they *lost* it.
Oops......
Needless to say, I told them, they BETTER find our folder with that abstract, etc.
Finally they did. We had took out our original loan from a local bank, and the bank was bought out by a bigger bank part way through the loan. Instead of leaving our paperwork locally, they moved it all to the main bank. I was not a happy camper.--------My signature--------

Goodness! I'd kick them straight in the midsection if I could!
I'd talk with a lawyer and see what your options are. I'd also contact the mortgage company and get the name of the person on the phone with you when you call. Explain to them what's going on, write everything done that you've discussed, and tell them that if they don't fix it by the end of the day then you're going to your lawyer about it. I'd also tell them that every single time it happens again, you're going to the lawyer about it. They should also be responsible for the overdraft fees because it is an error on their part.
Report them finally to the Better Business Bureau. I can't imagine that companies like that would realistically be able to continue to function with the horrible money management methods.Wife to DH since 10/31/2002!

Does your mortgage company's name start with an "o"? Mine does, and they suck too.

It is troubling what you are going through, believe me I have been through some doozies with a few mortgage companies.
That being said, don't think your mortgage company problems will magically go away when the company goes under and your mortgage gets sold. Every mortgage company makes mistakes. Every single one of them, we've have our mortgage sold 3 times and have had problems with each company screwing up something. It's why you as a customer must make sure you have a thorough paper trail and you stay on your toes, and double check everything for them. It seems companies no longer do their job properly at all and it's now your job to make sure it's done correctly each and every month. Don't rely on them to do it right, you check on them each time and make sure they are.

Have you heard of that new movement "Produce the Note" that is going on right now? Basically people that are facing foreclosure can stall by demanding that the mortgage companies produce their original note which they have to do under law if the the homeowner requests it. These mortgage companies are so disorganized and mismanaged it takes them months to find the paperwork. It has been a real eye-opener to see just how ineptly many are being run!

That is so crazy. First thing I would do is close my accounts with them other than the mortgage account so that they cannot get access to the rest of your money, go to local bank to open a new account that has a good reputations and is FDIC backed or a credit union. Secondly, I would make copies of every mortage payment you have made this past year, not just verbaly telling them but actual proof on the form of paper, then I would go to a Mortgage Loan Officer at the bank with the proof and tell him to freakin FIX IT NOW or you are getting an attorney, and finally if no response from Mr. Loan Officer I would go definitely to a banking attorney!!
