    Default A letter to my creditors

    I want to send a letter to all my Creditors that states what my intentions are, and also to advise them not to contact me any longer. Any advice on the wording ???

    I found this sample letter here.

    Sample Cease and Desist Letter For Debt Collectors

    You can use this cease and desist letter to stop debt collectors from calling you. Once the collector receives your letter, the FDPCA allows the collector to contact you one final time, in writing, to let you know what action, if any, the collector will take next.

    If these a$$holes ARE working with you ( even if they are calling ) yes this will legally stop the calls. However, believe me, make sure you really don't care if you pi$$ off the wrong one and that you are ready for what may come. I have been following you and have read the replies but I can tell you this...I have 2 really good friends that were behind on a credit card. It was NOT a large amount as was stated in a previous post. More like 3 to 4 thousand. The card company took them to court with a lawsuit right here in this ( our ) county. They also won. 25% of his paycheck was garnished right there in the courtroom starting with next paycheck. That is 25% BEFORE anything taken out such as insurance, 401, taxes etc. He works at Home Depot so no, he is not wealthy. He is a floor worker. The garnishment stayed until every last dime was paid back. So, no, it does not have to be a large sum of money for them to go after you in a lawsuit. As said their's was between $3000 and $4000. So if they file a lawsuit theirs will come out first and you and the others will get whats left.
    If they are working with you I would leave it alone. Change your phone number. I did. Had no choice. You can always call them 1-800 or 1-888 from a pay phone if necessary. I know someone will disagree with me but been there and done that. Believe it . Don't rock the boat if there isn't a storm.

    Oh yes, our friends also had to pay the credit cards companys attorney, traveling compensation ( because it is held in your county ) and court fees along with their court fees because the credit card company won. That is in the fine print in your agreement. Dig it out and read it. I did after this happened to them I dont throw any of it away.

    I would hate to see you get in deeper especially after you are all gung ho on digging out from under.

    The thing is they are going to get paid by the debt management company, they just have to wait for them to get the proposals out and things get going thats all. I have every intention of paying everything. And i am just as eager to start paying. I want out !!!

    I do not want to make things worse, so I guess I will leave it alone,after they start getting payments they may calm down.

    They won"t calm down until the back payments are caught up After six months it is written off and you will get a Wtwo ( sorry my keys are messed up ) for the difference of what you paid and what was owed unless the whole thing was written off then you would get one for the whole amount. If you have a written off card for $5000 then you would owe taxes on that $5000. If you haven't been paying anything and make just one payment it starts the whole 6 months all over again. We had one with Chase that we settled on for $1400 difference ( lesser amount ). We will owe income tax on $1400.

    I would seriously consider changing my phone number if possible and making it unlisted. When I talked/talk to them and they ask for my number I tell them our situation is really bad and we have a child in the house. These phone calls are making her ill and I've had her to the doctor and he put her on medication. So no, I'm not giving my number. While this is 100% all true they also do NOT want to mess with a child/minor especially as the phone call is being recorded. Definitely do not want to be sued for harassment and causing children to be medically treated. Would this work for you? Mine is real but hey....if it works and you can use it use it.

    If you change your number and unlist it only give it to who you absolutely have to and then they can't be calling your friends or family either.

    Maybe the debt place will get the stick out of their behinds and do what they are being paid for. My guess is they will take their time. Meanwhile your phone will keep ringing unless you change the number. They already have your address if they need to get hold of you.

    But again, I wouldn't pi$$ them off any further especially if you are close to the 6 months mark. That is when the lawsuits etc start if they are going to do it. Chase will settle for less. American Express won't. From what I'm hearing Bank of America ( godfather of them all ) won't either. Don't know. Also if you get to the point of settling for lesser amount BEFORE it goes to being sold out the money goes to them. When we paid the lesser it was Chase it was sent to. NOT a collection agency.

    American Express is horrible. But they will work with you. Not at first but they will. Their collection agency is Collect Corp and they do collect for American Express not themselves. Once AM goes to collections they will no longer even talk to you on the phone. It has to be Collect Corp.

    I hope things get better for everyone. You, us..everyone. If you have any questions that I might be able to help with or want to talk PM me. I'll help if I can...otherwise my best wishes go out to you...stay strong BUT be patient. Don't jump the gun and think everything thru before you jump.

    Sorry Tony.....no advice except that you playing 'mr nice guy' with good intentions isn't going to stop the AH from contacting you........save the stamp! All they will say is "show me the money!"

    One thing I DID do was when they called and they said this is being recorded ( which as you are aware they HAVE to tell you if it is )...I very sweetly said " and I must tell you that it is also being recorded on my end also on this such and such day of whatever month and the time." They will very quickly tell you that they do give permission to be be recorded. After you tell them that you are both recording the same conversation so what would the problem be with doing so they will repeat I do not give my permission to be recorded. At that point you tell them that in that case you can only assume that if they are unwilling to have "2" copies of the very same tape that you are assuming that they have intentions of either harassing or threatening you and don't want it recorded. Because if it a was a "nice" call then they surely wouldn't care if it was recorded or not because they weren't doing anything wrong or threatening.

    This totally throws them for a loop cause they aren't expecting anyone to say that THEY are being recorded also. Got to remember most of the collectors are barely above minimum wage and probably inexperienced. It totally throws off their thought process from the sheet they are reading from The older seasoned ones not so much but still.....They know that if they are and they make just ONE mistake they are screwed. Lawsuit to the company and they are fired and out the door.

    Only if it gets to the point that you really need to. Again, don't rock the boat if there is no storm.
