I don't know if this is the right forum for this but it seemed right...
I have negative credit and outstanding bills from my marriage to Bob and even though I have the divorce decree stating that he was responsible for the outstanding debts they were incurred in my name (he had no credit - and hence, I no longer have credit) and I am still being held responsible as he just blew them off. I can not even get a checking account. I do not know how to fix this - I was told to just contest everything on my credit report but the "payees" are still active and want their money(they don't care who pays or how many times they are paid as long as they collect). I cant afford to pay all these - one was a $742 debt incurred AFTER I was out of our relationship but I can't even declare fraud because I had made him co-signer on the account and he never closed it - I took my name off the account but amazingly there is no proof of this! I was wondering if anyone here had any advice as to how to take care of this - I do not have extra cash to throw at these bills and Bob will not even discuss them with me. Yesterday I received a tax audit for the year that I left and he filed and evidently still filed with my name - they will take my tax returns to satisfy this this year as they do not even have an address for Bob and I did not even have an income while I was with Bob. THe last four times I have filed I had to file an injured spouse form so they wouldn't confiscate and apply my returns but I still end up not getting my whole return and though I file in January I don't get my refund until late June - early July because of processing time for this situation. I am so frustrated!! Do you ever become your own person once you divorce if you gave up your whole 'personage' while you were married??
Also my student loan was involved in our Bankruptcy while we were married and though they can't be discharged it went into default despite the fact that I made my monthly payments. Evidently they sold it a few times and I had paid it in full - I have a stamped receipt and my origional promissory notes marked paid in full but they are still on my credit report to some educational service as owing $24,000 - my origional loan was for $6000 and I paid it off completely. I can't seam to find whoever I need to get this removed from my credit even though I have sent copies of my paid in full receipt to everyone!!
Kimmee--I've had errors on my credit reports before and I was able to make copies of the proof that I had, and mail them directly to the credit reporting agency with a note on each and every one of them explaining this account was paid on such and such a day, see paper attached, etc. Perhaps sending a copy of the divorce decree, just the part that states he is responsible will get you somewhere with this. I hope you can get this straightened out
I would take him back to court regarding the debts he has not paid. Not sure how many years you have been divorced, but I would think that a judge wouldn't take too kindly to Bob not upholding his responsibilities from the divorce decree.
