I have 2 questions. We are slowly trying to dig ourselves out of a mess we made a few years ago (stupidly putting things on credit cards!)- well- the stupid part was using credit cards and both of us being laid off of work. Eventually my hubby went back to work- but I had trouble finding s job since I was pregnant. I could not really go back to work with my hubbys schedule and no money for a sitter.
We paid off a line of credit, a car, 3 credit cards and have 4 that are coming back to haunt us.
First- my hubby got notice to court for a credit card- he showed up the lawyers for the credit card company did not show up. The judge ruled in his favor and said they have 30 days to issue an appeal. This credit card is past the statutes of limitation (which I believe in 4 years in our state). I am having trouble getting the exact date of the last payment. Now if they appeal it- how can I get the exact date? Also, if they don't appeal it- do we have to pay it back?
Now today I received a notice that I have to go to court- probably over one card that is way over the statutes of limitations. I can not find a single bill from the credit card company or any of my bank statements. Should I try to contact the credit card company and ask them to issue me that information or when I go to court for this- is the laywers representing the company supposed to provide that information to say that it is within the statutes?
Thank you so much!! We are still trying to work with a few companies to get everything all squared away and really don't have a huge lump sum to pay off these lawyers for what they want. Earlier this year I had to pay a company over $1000 for a credit card that was only $350 when I paid on it last- they would only deduct 10%- since there was "lawyer fees" attached.

The only thing I can suggest is for the credit card company that didnt show up, now the ball is in their court, do nothing on your end, they might lose and you end of owing nothing.
With the 2nd one, I wouldn't do anything, usually after 7 years while sometimes the creditors try to get you to pay they can't do anything about it and it's no longer on your credit report, so if it's been over 7 years dont make a single payment not even a penny or it will go back on your credit report for 7 more years.
While it's not always the way to go, 7 years and it's off your credit report so leave it be.

Another good website for all matters credit related is creditboards dot com. There's a newbie thread to read first which answers alot of questions. Read it, then post your questions. There's a forum on there called Help-I've Been Served! There's also a link on there somewhere for the statute of limitations for all states. There's lots and lots of good information on that site and the regulars who post there are real helpful.
