    I was never served paperwork, someone came to my moms house and dropped it off, and the through the mail. I use my moms address.
    If papers were delivered to mom's house then you WERE served.

    These bills I have are about 6 or 7 years old and haven't been paid for about 3 years now.
    did you know that it's 7 years from the last payment/inquiry? not when the bill was incurred?

    The last letter I received said they had won their judgment and they were now free to levy my bank account or garnish my wages.
    Are you certain the papers were legit? go back to the source of the "papers." Check to be sure it is a true docket. While you're at it, tell them you weren't served with notice to appear in court.

    Or is the word here. Did they say OR or AND?
    if it's or, they CAN NOT do both. Not to say they won't try though. But they don't have a legal leg to stand on.


    I don't know if they can honestly do both though. Again, I never got a court appearance date.

    How did this company... collections company I assume, get your work information? Did you give that infor to debt settlement company?

    oh, BTW.
    Stop the auto deposit IMMEDIATELY! Actually if you CLOSE the account, the auto deposit will be returned to employer. Ask your emplyer for a paper check.

    Move your checking account to someone else's name. And continue to pay your debt with wage garnishment. (Which is only allowed to be up to 25% of net income. Federal Law. If state law is higher, the Federal law supercedes)


    I'm ALL for someone paying back debt, but I am NOT for shady companies who practice scare tactics, and basically debilitate a person's ability to purchase basic needs of food clothing and shelter- ESPECIALLY if they're trying.

    I've looked through your other posts and see that you came here to share your story and I commend you on that. People NEED to know this stuff.

    I am greatly concerned that your debt settlement company triggered your cc company to get the legal proceedings rolling. It sounds like the cc took matters in their own hands when they learned you wanted to settle- rather than settle, they sued - underhandedly. (at least I think so- I could be wrong for lack of all the details.)

    I am REALLY disturbed about freezing a checking account. That just puts a person under. And how can one 'pay!' if no access to funds! And then there's return check fees... etc etc.

    It's just wrong.

    I am not sure but I dont think they can take from your paypal account since it's not actually an account where you have routing numbers and a checking account number, ya know?

    I dont think they can take everything from your accounts either, now dont quote me on that but I've never heard or someone going into your account and taking your money for a unpaid debt, I also agree that where are they getting your personal info to garnish wages? Sounds like it's more of a scare tactic.

    Thank you so much for responding to my post. I am assuming they got my info from the credit card company or I believe your credit report has your employer info on it. This is my own fault for not checking into the paperwork better. I believed the woman at the settlement company when she said if there's no court date to appear (and I faxed her a copy of the paper) then it most likely isn't legit. I did take all my money out of my checkings and didn't have much in my savings, but took that out as well. I was just starting to save, and honestly my debt has been bothering me alot lately, but being so far behind, I'm not sure what I can even do at this point to get caught up, because to settle these company want a lump sum of money, not payments, and I don't have any lump sums of money.

    The last time I looked at my credit report, all that information was there...job etc.
    I'm sorry things seem so hopeless but just keep working on your debts what you can.

    Check your local County Clerk's office. Garnishments are filed in County Court Civil (Small Claims) or Circuit Court Civil. You might even be able to do an online check under your name for all recordings. If not, call or go there to check. Good luck!!

    This is true. "Skips" are the people that owe money and don't/won't pay or can't be found. It is the job of collections to comb through the paper (account info, credit reports, public records etc.), follow the trail and find them. The tactics they use to gain info can definitely be questionable.
