Need Advice On Foreclosure
Well, we knew it was going to be just a matter of time. We had filled out an application to go thru Loss Mitigation with our mortgage company and never heard a word on it. Just the weekly phone calls from them to see if the situation had changed, etc. I had a couple messages left on the answering machine telling me they were trying to reach me and I would call back the number they gave me only to got around and round their phone system. No body could connect me directly to that department. Not even a supervisor! That's ridiculous!
I get a letter in the mail, dated August 29th. It wasn't ran thru their postage meter till the 2nd of September. It says I have 7 days to contact them. I was on the phone 45 minutes on the 29th, talked to six different representative and nobody could help me. I call yesterday, once again I was on the phone 30 minutes to find out they had put us in Foreclosure on the 4th! They gave me the same number I called directly to reach the person who was suppose to be in charge of our account. I get put back in the system and have to start all over. I finally tell the phone rep I'm tired of getting the run around I want to talk to this lady. She tells me all I can do is call the 'useless' phone number or she can email her. I tell her to email her and then I wait. No response.
DH and I called the lawyer at Legal Services to talk to him on it, as he told us too if the mortgage lender put us in foreclosure, and of course he wasn't there.
I didn't sleep last night. DH was up tossing and turning. We are scared to death as we have no where to go if we lose this place. If anyone whose been thru this can give us some advice. We would greatly appreciate it.

I have no advice but I just want to say I am sorry. It sounds like they were trying to give you the run around so they could put it in foreclosure.

No advice, just good thoughts being sent you way. On that note, seems like they are surely giving you the run around.

wow.
ummm... spiritually and literally, are you fighting a losing battle? would it be easier to swim downstream? go with the flow. What's the WORST that could happen?
at what point would you consider stopping paying the mortage and use that money to pay for a deposit on an apartment and moving expenses?
i guess what i am trying to say is that, for me, at least, at some point trying to save a losing battle becomes pointless. at some point it even becomes hilariously funny, in a pathetic sort of way, like when i was trying to save my marriage.
then comes a sense of peace. whatever is going to happen is going to happen, and let it.
for me, anyway, to get out of the way and let god be in charge.
god could have bigger and better plans for you.

freedom accounts/sinking funds that ebb and flow
then live on the rest!
i am trying something new. LDS church advises savings or debt repayment should be the same as the tithe. 10% each.

I would spend some time on the phone with my local social services and charity groups like the Salvation Army and see what advice or assistance they can give you. Here in Bradenton our Salvation Army has seperate family assistance programs. Low cost public housing may be gotten from your local Housing Authority. Instead of wasting your time hanging on the phone with folks who don't seem to care seek out those that are willing to help.
You will find a sense of peace once you start dealing with them. It sounds weird but once your resigned to the fact your going to be having a change you'll sleep better.

Did you know that a 4 year student paying $20,000/year who finances their education graduates with over $103,000 in debt to start? But a student who works and pays cash and takes 6 years to graduate ends with $6,300 in their pocket! So much for "getting a head start by financing!"

I have been through this and my advice is to keep calling until you reach your account rep. or someone who can find out where your Application for assistance is. You might try pressing the button for "foreclosures" if they offer it on the phone and try and get through that way as you may not have been assigned an account rep. yet since it's now in foreclosure process. It does normally take some time, even a month for an application for assistanc to go through.
Since they have sent your mortage to foreclosure you will now be charged lawyers/legal fees. Mine amounted to approx. $2700.00. You can still be approved for a "repayment Plan" through their Loss Mitigation dept. but now they will figure in the legal fees with the amount you are behind on your mortgage and design a repayment plan that includes all of it. But, your monthly income you provide has to prove that you can meet the new payments. The only reason we had to pay legal fees was because we were waiting on an approval from Loss Mitigation and we found out too late that the new contract had been sent by Fed EX and we never recieved it. He sent another contract and I found it in my MAILBOX!!! gRRRR!~ It had to be notorized and sent back by Fed Ex within 24 hours.
It all boils down to "how badly do you want to keep this house". In my situation, it would kill dh to just up and leave or lose our home. I could care less but for his health I will keep doing all I can to keep it even thought it's stupid and we are not financially able to keep it. We need to sell it, pay off all of our bills with the equity and move on but I can't convice dh of this. Not always a good idea but whose to say who is right.
Our monthly payments are now $285.00 more per month. It was hard to meet the smaller payment, now we have a much higher payment and it cannot be even "1" day late or it will go into foreclosure immediately. WE are also not allowed to refinance because even though we make our payments on time, we are still considered behind in payments and are reported as being late each month to the credit bureaus. So basically, your credit is ruined whether you are foreclosed on or are making payments through a repayment plan.

Though I agree it might be time to reevaluate if this is the time to "cut the losses". If you are able to get it "held" can you truly afford it long term?
