    Exclamation Tax question, help needed

    At the end of last year (December 2008) we received a letter from the state of NY stating that *I* owed back taxes on income of some $50k for the year 2004. I did not work in 2004 and DH was the only one working and was active duty with his home of record being the state of Texas (which does not have income tax). We sent them a letter stating all that.

    They sent us a letter that says:
    "Generally, both husband and wife are responsible, jointly and individually, for paying the full amount of any tax, interest, and penalties due on a joint return. That means if one spouse doesn't pay the due tax, the other spouse may have to pay. However, if qualified for relief, a spouse may not have to pay the tax, interest, and penalties specifically related to the other spouse (or former spouse)."

    WTF?? They want ME to pay taxes on Dh's income that is basically counted under the state of Texas. Can they do that? I mean, what if dh's home of record was another state that had income tax, would that mean we have to pay on this twice?

    Now we have to request a Consiliation Conference for more bull. WTH!!!

    No they can not charge him state income tax. Don't stress it. As long as his military income was his only income you have nothing to worry about. Just gather up your records and get in touch with them to get it straightened out.

    It would probably be worth your while to hire a CPA to help you with this matter.
    If you could kick in the pants the person responsible for your problems, you wouldn't be able to sit for a month.

    Did you know that a 4 year student paying $20,000/year who finances their education graduates with over $103,000 in debt to start? But a student who works and pays cash and takes 6 years to graduate ends with $6,300 in their pocket! So much for "getting a head start by financing!"
