Not sure which forum to put this one in either, so here we go.

"Indigency" is something you can claim that basically states you are broke and have no real means to pay things back without devastating effects on you and/or your family.

IF, and ONLY 'if' you financially qualify, you can declare indigency to remove court costs. I did it when I filed a Civil Small Claim against a previous land owner that I rented from years ago. He had not given my security deposit back and for NO REASON. He was the married type who, if you didn't sleep with him, he'd kick you out. Here I was, the ONLY tenant who not only paid on time, but paid six months in advance (I do that in case I ever go into hospital or loose a job .... it buys time to get on your feet again), kept my yard pretty with landscaping and flowers. ..... but wouldn't put out, lol.

So, I took him to court (and won), but it didn't cost me anything in court fees to file the case.

Now in this case, he had to pay the court fees for being in the wrong, as well as pay me back too. But none-the-less, most people would have had to pay the court fees PRIOR to getting a docket number to obtain a court date. So, indigency helped me by NOT having to pay court fees in advance, or AT ALL, ever!

I hate to say the next part, for fear that thugs will misuse this right. Indigency can also be declared to get out of a fine, for whatever, lets say .... a speeding ticket. Of course, if you are healthy, the courts may want you to perform several hundreds of hours of community service instead, so BE CAREFUL when you exercise it.

Have a great day,
Sandi
