Not sure what to do???
On new Years eve at 7:30 pm we where going from Walmart to the dollar store. well we where turning to go over the brige and got Hit on myDH side.At the time it did not seem to bad .But now my back it hurting bad It is hard to get up and I cant sit for long or stand. I am just hurting. I was thinking the next day that I was just sore and it would go away. I said to my family ( I wonder why I am the only one hurting. Then my 14 DD said because my knee went in to your back mom when we hit. I looked at her knee and she has a big bruse the size of her hole knee cap.) I was putting off going to the Er because I dont like doc. It was the other girls falt and her incsure people call today and she was so rude . Like why was me and my teen the only one hurt when we was not on the side that got hit. I was like I dont know why but my teen had a big brude and my back is getting worse. Any way I am not sure to call a lawer because the inc. people are so rude to me.

I would call a lawyer but first I would be going to the Dr to make sure its only a bruise on your dd and your back needs to be checked out.....
FernYes I'm out of my mind. It's a dark and scary place in there.

If I were you, I would call your insurance people first. They have lawyers who can help you. Then you would not have to hire an outside lawyer.
Good luck,
Keep us posted.

I wouldn't count on much from any insurance co. other than reimbursement for medical treatment. You weren't hurt badly enough to need immediate care, obviously but it's not uncommon to hurt and be sore for days after an accident. My dd was hit by a pickup as she walked across a parking lot on campus. The pickup was going about 25 (according to the driver at the scene of the accident). It hit her just below the knees and threw her backwards about 15 ft. She landed on her back (on her backpack full of books). She got up and walked around (
NOT a good idea by any means), refused an ambulance ride to the hospital but had to go by car. She was so sore she could barely move for about 10 days. To this day (3 years later) she has an indentation just below her knee and what looks like a bruise (but can't be, is just a scar). We consulted a paralegal friend and dealt with the 'opposing' insurance company ourselves. We got a 'fair' settlement out of them which was reimbursement of all medical care and about $600 for pain and suffering (this was fair according to the attorney that our paralegal friend works with in accordance with prior, comparable cases). The courts have really cracked down on personal injury suits and a person has to be really, seriously injured to collect anything (substantial) anymore. You should get checked out by a dr. for sure b/c injuries can show up days later and back/neck problems can persist forever after an accident. I hope that doesn't happen to you.

I would call your insurance company for advice. I also agree with Lisa when she said, "I wouldn't count on much from any insurance co. other than reimbursement for medical treatment." I was in a auto accident and had to go through months of therapy and traction on my neck. That was 10 years ago and I still have to have go to a chiropractor almost monthly for treatment. The accident wasn't my fault either, and I only received $1500 after all medical bills and lawyer fees were reimbursed. I have spent well over that $1500 on medical bills related to this injury. I suppose I will always suffer from it.
DO you have PIP on your auto insurance? If you do, contact your insurance and let them know what has happened. When you seek medical treatment mail them the medical statements and they will send you payment for the bills. Also, if you have any loss wages, they will reimburse them too if your employer sends them a statement. I just went through this in July thanks to DS#1 having an auto accident. We were lucky to have PIP because they paid all his medical bills and reimbursed him his loss wages. I always carry PIP because I learned the hard way. I didn't have it when I had my accident, but I swore after that I would always carry it. It doesn't make that much of a difference on my premium either.
Good luck! I hope you and your daughter to heal quickly.~*Michelle*~

Glad you went to the doctor. That is the first place to start. Glad you talked to a lawyer too. It can get pretty sticky. But I will tell you that here in Missouri, we are a double emdemity state....which means if you have health insurance they must pay your bills and what ever your private insurance company gets from the car insurance is there business. My brother was in an accident that almost killed him a couple of years ago and his private health insurance didn't want to pay because it was a car accident. I reminded them of Missouri's law and they paid up. YOu are still responsible your co payments. Please be sure and check the laws of your state. I know they differ. But alot of people go to collections on these kind of bills because they are afraid to challenge there private insurance companies. Hope this helps....Kathy
