Update on our house!
DH and I have spent the last month or so trying to work something out with our Mortgage co; they are not very helpful at all..basically saying there is nothing they can do to help us. We sat down and went over our budget and even if I quit smoking, (which I am trying to do), we would not have enough money to stay in our house and pay down all of our debts and save. We went to see a bankruptcy lawyer on Thursday...we started the paperwork to file a Chapter 7. Our lawyer told us with our debt, our income, and DH's medical problems, we will have NO problems filing. We both tried for it not to come to this, but it was either this or a foreclosure with the possibility of having to pay the excess...which we cannot do at this time. We are both taking this as an opportunity to make a fresh start. I don't know about anywhere else, but here in Ohio, it is now a law that when you file bankruptcy, you must go thru Credit Counseling, too. That is actually a good thing, in my opinion, it will help us to make wiser choices in the future. We didn't plan on DH getting cancer at 36, but this just goes to show that it's important to have an EF and try to be prepared for whatever comes your way.
Anyone else been thru this?

I've been through bankrupcy as a result of overwhelming medical bills. When they say "75% of bankruptcies occur because of medical debt" you and I are in that statistic. I felt a tremendous weight lifted when it was over. That was almost 2 years ago and I haven't regretted it for a minute. Hugs to you and please feel free to PM me if you have questions about the process. If I had known how easy it went I wouldn't have been so scared. Especially walking into the courthouse.

I hope things turn out for you. I cant understand why a morgage company would not want to work with people. I know that in my area forclosures are way up and you would think a smaller payment would sound better then no payment.

I'm sorry it's come to this for you to be able to keep your house, but the important thing is that you are going to be able to keep it and, as you said, this could be a fresh start for you and your husband. Thanks for the update and hang in there.

I'm sorry it has come to this. But, you seem to be thinking positive about it giving you the opportunity to take credit counseling and getting a fresh starts! Best of luck to you both!
