dil surgery set, she lost her job!!
OMG, I can not beleive the crap that is happening here.
dil is set to have surgery the 6th of march. The Dr. is going to give her a shot to shrink the fibroid,, IF insurance pays for it!! If it isn't approved, she won't get it.. What a bunch of balognie,,,
Anyway, went back to work to tell them she needs 6-8 weeks off work...Well did you know that to get the FMLA, that you must be employed for 12 months?? Her company got bought out 8 months ago,, so she does not qualify.
she told her work she needs the time off, ,They told her that she needs to start looking for a job, as of March 1st, she is no longer employed. If she finds a job before that she can go ahead & start, otherwise come to work until the 29th of Feb. after that her position will no longer be there.
Who is going to hire her 6 days before she has surgery?? Then she has to have 2 months off!!!
Now she has no insurance & has to go on cobra ,, how is she suppose to pay that with no job???
I am SO frustrated I could just scream!!!Pine trees, with their needles pointing up to heaven, represent everlasting light and life.

I am so sorry, no part of that seems fair. Most places are "at will" employers meaning that they can let go anyone for any reason at anytime with no explaination. Again I am so sorry, I'll keep you DIL in my thoughts and prayers. Sending hugs and hope your way.

maybe she can apply for emergency medicaid, tell them the whole situation. And then I would check with the dept of labor and tell them what happened. Then I would file a leave of absent, family leave. I dont really think they can just fire her like that...

She does not qualify for the family leave.
They will not let her have a leave of absence, because when she comes back, her position will not be there. Another words they are getting rid of her position, to get rid of her. That way she has no recourse.
She was scared to death she was going to lose her job, if she did this surgery,, she was right.Pine trees, with their needles pointing up to heaven, represent everlasting light and life.

If they told her to look for another job, tell her to apply for unemployment AND disability. It can't hurt and if nothing else, they can point her in the right direction!

I'm sorry to hear about this. It is truly amazing how some companies will treat their employees like dirt.
It is times like this that makes a person was to be able to drop some not so subtle hints to everyone they know that this company or any company is not employee friendly and would drop a person in the middle of a health crisis.
My thoughts will be with her.

That stinks; FMLA is one of those that is a big help to many people but not everyone (including myself; office is too small to have to follow it). Here is a wacky suggestion; if your son has insurance through his work can they get married like now at the courthouse? That way she can pick up on his insurance without having a lapse.

How disgusting! It's amazing how some employers are able to abuse their employees like this these days - all in the name of the Almighty Buck! Quite a few employers are also now making people sign Arbitration Agreements (stating they won't sue them) as a condition of hire. NICE - free reign for them to really abuse their employees. I'd tell her to keep an eye on them to make sure they aren't just telling her her posiiton is being fased out and they don't 6 months down the road hire a replacement - if they do I'd be contacting a lawyer pronto.
I agree with the poster who told her to sign up for Unemployment. Tell her have THEM terminate her and then go file (hey one good turn deserves another right and as far as I know with 8 months in she I think she's eligible for partial benefits. Did she work some where prior to that cause she can claim on that portion of her work history as well?) then when she's having her surgery she'll have to put down that she's not ready, able and willing to work while she's getting better.
At least she'll be all signed up for UI once she's back on her feet.
Can she reschedule the surgery for a later date possibly? I'd check out Medicade as well and see if she can get on that - her Dr. would probably have to send in a letter stating that the surgery is medically necessary. I'll keep her in my thoughts and prayers.
I Hate Employers like that. I hope they get their just deserts! If she worked for a Union, they'd never be able to pull crap like that. Unfortunatly with all the Union Busters these days, Unions are few and far between.

Not my usual approach to life, but I'd be tempted to take this one to the Court of Public Opinion - call the local news and see if they'll do a story on it, make the company feel so shamed that they might change their minds, or perhaps others in the community will come up with ways to help - maybe even a job. I do think there are times when companies need to be "disciplined" by having their misbehavior become well-known.

She needs to find out for sure the last day that her insurance will be in effect. When DH lost his job a few years ago, we still had coverage for about 30 days, since they have to pay the premiums before the month they are used. Make sense? The March premium was paid in February, giving coverage until the end of March. Have her check it out. The worst case scenario is she may have to pay for a month of COBRA, so that her surgery is covered. By the way, the same thing happened to my step-sister a few years ago, when she had to schedule back surgery. She had seven years with the company, and they just told her to make the day before her surgery her last day on the job. Good luck to your dil.
