update on mortgage situation
Okay I have been chasing my tail all week on this and today is the first time I found someone with our mortgage co who is "over" our account after asking several times! I recieved a call from her today and she told me she had been going over our account and was confused by what was happening.......uhm me too...to I told her the story of how all of a sudden our payments had started being rejected and even though they showed us owing June and july our account went into full foreclosure status last week with auction date for august oh and how I had even sent the payments through western union after they mailed my check back! Oh and how I had even sent augusts payment and the reinstatement fee they said I owed just to make this stop and it was sitting in a western union account. She said that regardless of my account showing 60 days past due they didnt even start preforeclosure until one is 90 days past due and she had no clue where they got the fees from. Her biggest shocker was when she realized that the two payments totaled less than $450! SO there is almost $2500 sitting in western union and nothing had been done. She told me that something didnt add up and she was going to contact the atty that reps them and find out what happened and work to get the fees back asap. I have to call her first thing in the morning. Finally someone who might be able to help!

Gees, I do hope this all works out. What a mess, time consuming one too.
Sorry this happened but GOOD LUCK in getting it all straightened out.

I have to agree, this is one mess. I sure hope they fix everything and please keep us updated. BTW Glad you finally got a person who can help you fix this problem.

I have this problem with Wells Fargo constantly! They put someone in charge of our account and then ten different people want to call and talk to me about it. Ummmmm NO! I talk to ONE person. Then that one person works on our account for a month or two and it gets transferred to another somebody for one reason or another. It's very frustrating! And with Wells Fargo you can't even call and get your balance due! You have to call a special number, tell them what you want and then wait two or three days until they call you back with your balance due on the loan..IF they bother to call you back at all!

ok now that I am more calm about this and can sort of post an update that makes sense here is what is going on now....
Our loan has been taken out of foreclosure status, but not before the first auction notice went in the paper. I pulled our original contract along with copies of our reaffirmation and the mort co clearly breached our contract. Our contract clearly states that if even if they feel we have defaulted on the loan they have to send a letter to cure the default via certified mail and they did not. Even more frustrating is that they still have not posted any payments we have made and claim they are investigating why they havent. The rep I talked to told me we owed an amount almost $2000 less that what we were told to reinstate the loan that in fact we do not have to pay $1700 in attorneys fees. This was all after I said something about breaching our contract. I am pretty sure they realize they have screwed up, but it is looking like it may take time to get all the details worked out and find out exactly where it went wrong.

Wow, I am glad that you finally were able to speak to someone who is at least trying to help you. I gotta say I am not so sure that renting is a bad thing after all.

Really glad to hear that progress finally might be made.
You have been in a really sad mess.........and banks seem to be NOTORIOUS lately for making big messes!
